Report of the Portfolio Committee on Cooperative Governance and Traditional Affairs on the Local Government: Traditional Affairs General Amendment Bill [B16-2022] (National Assembly – sec 76), dated 21 April 2023:

 

The National Assembly referred the Traditional Affairs General Amendment Bill (National Assembly – Section 76) (hereinafter referred to as the Bill) to Portfolio Committee on Cooperative Governance and Traditional affairs.

 

Subject of the Amendment Bill

The primary aim of the Traditional Affairs General Laws Amendment Bill (National Assembly – Section 76), introduces minor technical amendments to Section 81 of the Local Government: Municipal Structures Act, 1998 (Act. No. 117 of 1998) (the Structures Act) and to Section 16 of the Traditional Leadership and Khoi-San Act 2009, (Act No. 3 of 2019) (TKLA). The amendment to the Structures Act is to correct certain references to the Code of Conduct, as the Code has been removed from Schedule 1 of the Local Government: Municipal Systems Act, 2000 (Act No.32 of 2000) (Systems Act) and inserted into Schedule 7 of the Structures Act, as amended by the Local Government: Municipal Structures Act, 2021 (Act No. 3 of 2021).

 

Enquiry into the subject of the Amendment Bill

  • The Committee interacted on the content of the Bill with the   Department of Traditional Affairs on 23 August and 10 October 2022.
  • A call for submissions on the Bill was opened from 13 February 2023 to 10 March 2023 in line with Rule 275(a) of the National Assembly Rules, which dictates that the Committee must give interested persons and institutions a period of at least three weeks to comment on the proposed legislation.
  • Two submissions were received but they were not related to the Bill’s subject matter.

 

Consideration of the Amendment Bill

The Portfolio Committee on Cooperative Governance and Traditional Affairs having deliberated on and considered the subject of the Traditional Affairs General Amendment Bill (National Assembly – Section 76), referred to it, and classified by the Joint Tagging Mechanism as a section 76 Bill, reports that it has agreed to the Bill.
