Report of the Portfolio Committee on Transport on the National Land Transport Amendment Bill [B 7D – 2016] (National Assembly – sec 76),dated  26 February 2020

 

The Portfolio Committee on Transport, having considered the National Land Transport Amendment Bill [B 7D – 2016] (National Assembly – sec 76), amended by the National Council of Provinces and referred to the Committee, reports that it has agreed to the Bill.

 

The Committee further reports as follows:

 

  1. The National Land Transport Amendment Bill [B 7 – 2016] was considered by the Portfolio Committee on Transport in the 5th Parliament.
  2. The Committee amended the Bill and reported accordingly to the Assembly on 27 March 2018.
  3. The amended Bill, [B 7B – 2016], was passed by the National Assembly and referred to the National Council of Provinces (NCOP).
  4. The Bill, [B 7B – 2016], was further amended  and passed by the Council and returned   for  concurrence to the National Assembly on 28 March 2019, but was not considered by the Portfolio Committee on Transport at the time because the term of the National Assembly had ended.
  5. The National Land Transport Amendment Bill [B 7D – 2016], as amended by the NCOP, was revived and referred to the Portfolio Committee on Transport in the 6th Parliament by resolution of the National Assembly on 29 October 2019.
  6. The Committee deliberated on the Bill on 11 and 18 February 2020 and on 26 February 2020 recommended that the National Assembly pass the Bill.

 

The Democratic Alliance (DA) raised a concern that amendments proposed to section 11 of the principal Act as introduced in clause 7 of the Bill may have the potential of being declared unconstitutional.
