The total entries on hand decreased with 19,25% between the 1st of April 2009 and the 31st of March 2010. The backlog in Ballistics decreased by 39%, in the Biology section there was a 33% decrease and 21% in Questioned Documents. The only environment to have recorded an increase in 2009/2010 is the Chemistry Section, with a 24% increase in total entries on hand.

(ii) The average processing time for samples in each category is depicted in the table below:

The average processing time is calculated by dividing the total number of entries finalized by the total number of days from the date of receipt until the finalization date. The average processing times reflected in the table above are inflated due to the increased focus on the finalization of backlogs and should not be seen as standard processing times.

(iii) As the Ministry, through the Secretariat, we have been working with International experts who are assisting us with identifying what are the causes of the backlogs and steps that need to be taken to resolving the backlogs.

(b) During 2009/2010, three (3) exhibits were reported missing, which calculates to 0,005% of the average number of exhibits on hand per month during the same period. This is a 50% decrease in comparison to the 2008/2009 financial year.

(2) Yes, processes were embarked upon to eradicate backlogs and increase turn-around times for the analysis of exhibits, such as the capacitating of the environment in respect of human resources, skills [through employee development], upgrading of equipment and the enhancement of analysis processes.

Backlogs at the Forensic Science Laboratory are deemed priority and increased efforts are being be embarked upon to ensure the eradication thereof. Part of this involves working through the Secretariat with International experts in assist the department developing more effective system, process and plan to eradicate backlogs.

With reference to his replies to question 813 on 19 April 2010 and question 1895 on 31 August, (a) what is the total number of Family Violence, Child Abuse and Sexual Offences (FCS) units that were reconstituted by 30 June 2010, (b) what is the total staff complement of each of these units and (c) what is the rank of each member of each unit?

(a) The total number of Family Violence, Child Protection and Sexual Offences (FCS) units reconstituted by 30 June 2010 numbered 115. As stated in my previous response to Question 1895 submitted on 31 August 2010, the re-introduction process is being conducted in phases.

(b) The placement of officers/members at the units is an on-going process. As of 13 August 2010, 1997 officers/members have been placed within the provinces in terms of interim placement notices. Provincial Implementation Committees have been established to add capacity on a continuous basis.

(c) The ranks of these detectives range from Lieutenant-Colonel to Constable. It would be counter-productive to specify the ranks of all 1997 officers/members. The allocated ranks at these units were determined by the Resource Allocation Guide of the South African Police Service.

The Police Reservists are appointed in terms of section 48 of the South African Police Service Act 1995 (Act. No.68 of 1995) which is not applicable to metro police services.

Metro police services may however recruit Reserve Traffic Officers and Reserve Traffic Wardens in terms of section 3A of the National Road Traffic Act (Act No. 93 of 1996). Municipal Councils may also appoint volunteers as Law Enforcement Officers (who are peace officers) to assist the metro police services.

a) Statistics regarding domestic violence are compiled per calendar year. The number of exemptions issued by the ICD in terms of section 18(4)(b) of the Domestic Violence Act, 1998 (Act No. 116 of 1998) in the relevant calendar years, are as follows:

(3)(d) The magazine was subjected to proper tender process which was won by African Spirit media as the producer of the magazine for a period of two years. The contract is until March 2011.

Earlier this year the National Commissioner looked into this matter and has spoken to the relevant SAPS officials and expressed our concern over the impact and costs of this media tool. However the department is tied into a legal contract until the tender is concluded.

(2)(a)(b)Depicted in the attached drawing, annexure "A" is the South African Police Service's (SAPS) standard specification for the identification parade rooms. Owing to the cost of these facilities, it is not provided as a standard at all police stations. Further attached, annexure "B", is National Instruction 1/2007, on identification parades. The standard layout of the identification parade rooms is in compliance with National Instruction 1 of 2007 and which further indicates that identification parades can be held outside of this purpose made facility as well. Annexure "B"

The overall width of the one way glass panel (not mirrors as stated in the question) is 6.0 meters (divided into three equal panels by means of vertical mullions) with a height of 1.305 meters.

The viewing panel consists of an anodized aluminum frame as per the indicated size with 9.5 millimeter thick laminated one-way safety glass (high impact) finished with a silver coloured reflective coating.

(3)(a)(i) The minimum size of the parade room is 9.660m X 3.500m internal dimension (34 sqm).

(3)(a)(ii) The size of the control room is 25 sqm and is the minimum size specification for the parade room and control rooms respectively.

(3)(b) The dividing wall between these two rooms is a 220m thick wall constructed with conventional bricks in stretcher bond brick laying pattern, with wire mesh brick force in every fifth consecutive brick layer and finished both sides with plaster. Wall of the parade room are finished with washable pva/ enamel paint. Walls of the control rooms are covered with carpet to enhance acoustic qualities. Support for wall over window opening as specified by structural engineer.

(4) The only audio communications equipment installed is a standard one-way intercom system between the control room and parade room. No other intercoms are installed between the control room and the waiting rooms, as it could result in accidental sound transfer, and witnesses are escorted in accordance to paragraph 15 of the National Instruction.

(a) In how many cases has it been found that persons have been wrongfully arrested by members of the SA Police Services during the period 1 January 2007 to 31 December 2009 and (b) what is the total amount that has been paid out by the SAPS resulting from claims of wrongful arrest in the above-mentioned period?

REPLY:

(a) The exact number o claims linked to unlawful arrest will take time to calculate and to separate from other claims. And this will take some time and resources..

(b) The amount paid in the said period would also take some time and significant resources to accurately ascertain as the amounts would have to be separated from other amounts paid not related to wrongful arrests.

I have stated however repeatedly stated that we will not tolerate police officials who abuse the law. We have now introduced greater civilian oversight of the Police through the IPID and Civilian Secretariat for Police Bills and these two agencies will need to address issue of Police abuses. In addition I have asked the national Commissioner to look into this as a matter of urgency and to identify training needs and where appropriate disciplinary action.

In addition we have recently completed an audit of police officials who are not suitable to hold office and will be making a public statement in the near future regarding this matter.

Yes, an investigation has been launched and is investigated by Nelspruit Organised Crime enquiry 06/06/2010. Investigations into the activities of human trafficking are still underway and I will not comment on suspects that maybe linked to the investigation.

The Department of Public Works (DPW) as the custodian of government facilities are the only authorized department to purchase or lease facilities on behalf of the South African Police Service (SAPS).

No buildings have been purchased due to the fact that no provision has been made within the Capital Works budget for such purchases.

Property is leased when there is no state owned accommodation was available therefore the DPW as custodian leases accommodation on behalf and for SAPS.

The leased buildings are used to accommodate the units performing duties in the relevant provinces to deliver a service to the communities.

(1) No.

The South African Police Service does not open or register a criminal case on the Crime Administration System (CAS) when an arrest warrant is received for execution. Section 331 of the Criminal Procedure Act, 1977 (Act No 51 of 1977) rules that any person who acts under a warrant which is bad in law on account of a defect in the substance or form thereof shall, if he has no knowledge that such warrant or process is bad in law and whether or not such defect is apparent on the face of the warrant or process, be exempt from liability in respect of such act as if the warrant or process were good in law.

The South African Police Service only deals with arrest warrants if issued by a magistrate.

The Department of Transport and Metropolitan Police agencies deal with traffic violations irrespective of whether the incident occurred in the presence of an official or not.

No complaint incidents whereby arrest warrants are being enforced by SAPS members against owners of vehicles in respect of traffic violations despite the absence of evidence identifying the owner of the vehicle as the perpetrator were reported to this office.

If such incidents are reported, a criminal case will be opened and investigated.

If any complaints with regard to incidents as mentioned in the question are known, you are kindly requested to submit the particulars in order to allow a proper investigation.

(1)(a) The current rental period for Wachthuis is nine (9) years and eleven (11) months. The commencement date was 1 April 2009 and the termination date is 28 February 2019. The contract was signed in June 2009 retrospective to 1 April 2009.

(1)(b) The current annual rental of the mentioned building is R 45 685 056-00 with an escalation of 9% per annum.

(2)(a)(i) There are currently two thousand three hundred and thirty eight (2 338) members housed in the mentioned building. However, the SAPS Headquarters consists of various buildings in the Pretoria Central Business District which are collectively known as SAPS Headquarters, Wachthuis. The total staff compliment of all the buildings of the SAPS Headquarters is currently 6 430 members.

(1) On 22 December 2009, Mr C Fick of Somerset East, complained about pollution by the local Municipality of the Little Fish River, which flows through the Clevedon plots, Somerset East. This pollution is caused by sewerage that spills into the river.

(2) Somerset East CAS 281/12/2009 – Unlawfully and intentionally or negligently commit any act or omission which pollutes or is likely to pollute a water resource – was opened and investigated.

(3) The investigation was finalized during May 2010. It was delayed due to Forensic reports and a request by the complainant as he was in consultation with the local Municipality.

(4) The docket was sent to the Public Prosecutor, Somerset East, who forwarded it to the Director of Public Prosecutions for decision.

During 2009, seventy one (71) employees completed the sign language course (Beginners, Intermediate and Advanced level). The latter is to advance to a sign language interpreter's course by the end of 2011 and have a pool of qualified sign language interpreters stationed in all provinces. The aim of the course is to facilitate communication with deaf colleagues in the SA Police Service and community members.

External registered sign language interpreters are being utilized should the need arise to have sign language interpreters at all police stations.

(1) I have on a number of occasions stated that there is a process underway to

audit all weapons within SAPS and to look at steps that need to be taken in this regard. This is a detailed process and cannot be completed overnight. I will report back to the honorable member once this process has been completed.

(2) However pending the outcome of this audit the following steps have been taken to combat these thefts and losses of the R5 assault rifles:

· Firearms training is presented to members during different types of courses presented by SAPS;

· During shooting practices emphasis is placed on the handling of firearms, safeguarding and ensuring that members comply with the competency criteria as prescribed by law;

· Firearms are marked with the dot-peen and a unique SAPS emblem to improve on the identification of official firearms;

· Firearms are tested for Integrated Ballistics Information System (IBIS) purposes to ensure that the SAPS has firearms profiles for each and every official firearm;

· When members report on duty, firearms are booked in the SAPS 457 registers and confirmed by commanders during parade inspections on the SAPS 15;

· Stock-takings are conducted annually by provinces and divisions, confirming compliance as prescribed in terms of Standing Orders Stores 48 and 55;

· Audits are conducted by Internal Audit and inspection capabilities within divisions and provinces with specific emphasis on firearm management related issues, and

· A task team was appointed to visit provinces and divisions to ensure that firearm losses are properly managed and attended to.

(1) In reply to question 190 on 24 March 2010 it was clearly stated that information on rural crime including murders are discussed and analysed operationally on a weekly basis as well as at the bi-monthly meetings of the Rural Safety Priority Committee attended by the relevant other stakeholders. It has also on numerous occassions that the police do not keep seperate statistics on farm murders and such statistics are listed under the category of murders as a murder is a murder no matter where it occurs.

(2) I have had numerous meeting with organisations representing different

sectors within the farming community. Arising from these meeting I have, together with these organisations, already issued statements on the matter.

REPLY:

(1) (a) All members appointed at the ports of entry are trained in programmes dealing with concealment methods and the identification of suspicious items (including narcotics). These members are also trained to identify different types of drugs during their training in the following training programmes:

- Basic Police Training in the Basic Training Institutions;

- Basic Course for Border Police (previous programme) or Introduction to Basic Border Policing Learning Programme (new programme);

- Borderline Introduction Course;

- Dangerous Goods Course;

- Induction Programme for new and detached duty members deployed at Ports of Entry; and

- Narcotic Detection Courses initiated by United Nations Office on Drugs and Crimes (UNODC).

In addition to the above capacity, commercial land ports, airports and seaports have the services of police dogs with a capacity to detect narcotics (30 dogs), endangered species (6 dogs) and explosives (32 dogs).

(b) All members receive in-service training in the identification of concealment methods and suspicious travelers, vehicles and goods. Specialized equipment eg X-ray scanners and drug atomizers are in use at major ports.

(2) (a) & (b) All operational members have attended and passed the Basic Police Training and the Induction Programmes. In addition to this, a special training programme was introduced for these members, namely the Basic Course for Border Police or the Introduction to Border Policing Learning Programme. Since the full establishment of this function in the SAPS in April 2006 under the Component Ports of Entry, 813 members were successfully trained in these programmes to date.

(1)&(2) The total number of railway police officials per province/region, as well as the optimal number of railway offices per province/region, compared to the actual number of Railway Police officers are reflected on the attached table.

The department is still in the process of recruiting additional members to ensure that we reach our optimal number of persons to be deployed as part of the railway police

(3) All crimes are reported at Police Stations and captured on the Crime Administration System (CAS).

To ensure the integration of strategic crime reporting within the rail- and SAPS environment, a 'railway related' indicator was implemented on 3 May 2005 on the CAS.

This field is compulsory to complete when users register, add or update information on the system, (in accordance with National Instruction 1/2001) and also to create a profile of the percentage of crime in the rail environment which contributes to the National Crime profile.

Users can select the values like building, harbour, other premises, parking areas, person, railway, shunting yard, train and truck, after selecting one of the following type of areas while completing or updating the type of premises information on the system:

· Metro Rail

· Spoornet: Goods and Passengers

· Spoornet: Transnational Goods and Passengers

A monthly ad-hoc report on all reported crime in the rail environment is provided by the State Information Technology Agency (SITA) to the Business Information Analysis Centre (BIAC) of the Division: Protection and Security Services (PSS). This report is analysed by members of the BIAC section of PSS at national level, and includes all reported crime in the rail environment, as captured on the CAS, whether Railway Police officials were involved or not. All these crimes include CAS numbers from the system, and therefore all cases can be proven. This report also indicates whether an arrest was made for a specific reported case.

Successes which are reported, include arrests and confiscations made by Railway Police officials. Each Railway Police Commander at Provincial level provides a consolidated report on successes to the Head: Railway Police on a daily, weekly, monthly, quarterly and annual basis. These successes are certified by the Commander at provincial level, before it is sent to national level.

All these reports are verified and consolidated at national level.

All successes made by Railway Police officials, are captured on the CAS system by members at local Police Stations. CAS numbers are provided to the Railway Police officials, which are utilized for reporting purposes and figures cannot be manipulated by Railway Police officials.

(1)Yes. Family Violence, Child Protection and Sexual Offences (FCS) units are being re-established in line with the cluster and the organisational structure has been finalised. The units are now being re-established in line with the Policing model at each of the 176 Clusters located throughout the country. The current focus is on ensuring that there is sufficient and adequate capacity in terms of both human and physical resources.

As I stated in my press release dated 30 August, The improvement of communications, coordination and accountability across the South African Police Service (SAPS) is one of the crucial tools that can ensure that South Africans are, and feel safe.

As the police leadership, our view is that effective communications should not be seen as a function and responsibility of the police leadership and management only, but that it should be a responsibility of each and every police officer within the Force."

Through its stakeholder engagement and public participation programmes, the ministry has in the past learnt of various instances where police themselves fail to effectively communicate with society which in turn creates an impression that they are not proactive, when in fact they are.

"You have instances where police search for some of the most dangerous criminals, succeed in arresting them and such criminals get sent to jail for many years. However, police still fail to go back to society to communicate such positive breakthroughs and outcomes. At the end of the day, due to this lack of communication, such vulnerable communities still remain susceptible and under impressions that the suspects are still at large. That is precisely the point we are making that this process needs to be improved from top to bottom and vice versa," he said.

Minister Mthethwa emphasized that the billboards utilised during the 2010 FIFA World Cup™, were part of a broader communication strategy which SAPS implemented, including a broad range of local and international media interviews, stakeholder engagements and utilising partnerships such as Primedia. To this end, the ministry appreciates the contribution of Primedia who partnered with us in terms of not only effectively communicating through various platforms but also contributing to the many billboards displaying the words: "Come FIFA 2010 World Cup, we are ready" in various provinces.

In total there were 10 billboards spread across the country totalling R315 000,00. Some of the billboards were given at no cost to SAPS as they formed part of Primedia's goodwill gesture, contribution and social responsibility to the fight against crime. The ministry endorsed and has consistently applauded this initiative which has immensely contributed in ensuring that some of the dangerous criminals remain behind bars. In fact, Primedia through their Crime Line initiative has recorded over 1000 arrests and R36-million worth of seizures since its launch in June 2007.

The ministry is under no illusion that the negative perceptions about the ability of the police to deliver a safe and secure World Cup, a strong message of assurance to both local and international fans was necessary. This message had to show that the leadership of the country was making this assurance and if history is anything to judge the safety of the whole tournament by, the investment were indeed worthy.

REPLY:

(1) The 2009/2010 crime statistics still have to be released. According to the 2008/2009 Annual Report of the South African Police Service, 6 740 sexual offences cases involving children aged 0 – 11 years (that is up to 11 years plus 364 days) as victims were registered during 2008/2009 (see page 14 of the SAPS Annual Report for 2008/2009). Rape is only one of the many subcategories of sexual offences. To provide information on specifically rape cases - sections 3 and 4 of the Criminal Law (Sexual Offences and Related Matters) Amendment Act, 2007 (Act No 32 of 2007) - an ad hoc request will have to be sent to Information Systems Management (ISM) to obtain a docket download of these specific cases. This can take up to three weeks to fulfill.

(2)(a) To obtain such additional detail, another ad hoc request will have to be forwarded to ISM. This will take at least an additional three weeks to fulfill. The resultant data will then have to be scrutinized to obtain the necessary answers. It may even be necessary to undertake additional analysis to complete the enquiry and peruse the actual dockets to verify the information. In view of the limited resources available to Crime Research and Statistics and the priority enjoyed by operational requests, it may take literally months to meet this request.

(2)(b) The answer to this part of the question would only be found in the court records. Crime Research and Statistics does not have ready access to such records.

(1) At the end of May 2010 a number of 380185 dockets had been scanned.

(2) The e-docket system will not be fully functional by 31 March 2011. The South African Police Service is following a phase-in approach with the implementation. The successful implementation is dependent on the availability of suitable scanners, network capacity and resources. The network upgrading is however dependant on the commitment and support of a third party namely SITA. The SITA processes might however be a major role player in the success of this implementation.

(3) Not all police stations are currently utilising the e-docket system. 915 Police stations are not currently utilising the e-docket system.

However as I mentioned in my budget speech there is now a process that is being developed as part of the CJS review to address blockages and to speed up the roll of the e-docket system

(4) Note must be taken of the fact that this is a sub-project of the Integrated Justice Systems (IJS). Yes, the e-docket will be shared with other entities such as the National Prosecuting Authority, Department of Justice etc. The moment the police book a docket out to court all relevant case information will be made available electronically to the NPA. All scanned images of dockets and their contents will also be made available.

REPLY:

The latest publicly available figures on farm attacks and farm murders were published in the SAPS Annual Report for 2006-07 (pp 275 – 276). Since then the SAPS has not kept a stand-alone strategic database on these crimes. The very same figures of 794 farm attacks and 86 farm murders published in the 2006-07 Annual Report were repeated and included by mistake in the 2008-2009 annual report (p 69). The SAPS and Minister of Police regret this mistake.

To answer question 1861 with regard to the 2006-07 farm attacks and murders will imply that the relevant section in the SAPS will have to work through the old farm attack stand-alone database. After determining all the relevant CAS numbers, they will then have to work through the original dockets (which would be spread amongst stations across the length and breadth of the country) to establish how many persons were (a) charged (b) tried and (c) convicted in connection with these cases. That would be an extremely labour-intensive exercise and the Crime Research and Statistics component of Crime Intelligence does not have sufficient resources to readily accomplish such a task. It will take at least two months to procure the relevant data for 2006-07 if urgent operational taskings do not entail any additional delays. To provide full details on the results of court cases linked to the crimes in question, would require a further perusal of the relevant court records. Crime Research and Statistics does not have ready access to such records.
