Comment: Renaming of High Courts Bill

The Portfolio Committee on Justice and Constitutional Development will be conducting Public Hearings on the Renaming of High Courts Bill [B5-2008], which aims to make provision for the renaming of High Courts of the Republic and to provide for matters connected therewith.

The hearings will take place on Tuesday 20 May 2008 from 10:00 in Parliament.

Comments can be emailed to the Committee Secretary, Ms P Sibisi, at psibisi@parliament.gov.za  by no later than 13 May 2008.

Invitation for Public Submissions by Joint Constitutional Review Committee 

In terms of Section 45(1)(c) of the Constitution of the Republic of South Africa, the Joint Constitutional Review Committee must review the Constitution annually.    

Members of the public are therefore invited to make written submissions to the Joint Constitutional Review Committee on specific sections of the Constitution that they feel need to be reviewed.

Comment: Expropriation Bill  [B16-2008]

In line with Parliament's constitutional mandate to facilitate public participation in the legislative process, the Portfolio Committee on Public Works (National Assembly) invites interested individuals and organisations to submit written comments on the Expropriation Bill [B16-2008].

The Bill seeks to: 

  •        Align the Expropriation Act (No 63 of 1975) with the Constitution, by providing for the expropriation of property, including land, in the public interest or for public purpose;
  •        provide for the establishment of the Expropriation Advisory Board;
  •        provide for the approval of compensation by a court and provide matters connected therewith.

Expropriation in the public interest provides Government with a tool to achieve its commitment to land reform and to bring about equitable access to all South Africa's natural resources.All written submissions must be submitted to Parliament strictly by no later than Friday, 16 May 2008. The Committee may call on interested individuals or organisations to make verbal presentations.

Comment: Prevention of and Treatment for Substance Abuse Bill [B12-2008]

In line with Parliament’s constitutional mandate of providing a national forum for public consideration of issues and seeking to act as a voice of the people, the Portfolio Committee on Social Development (National Assembly) will conduct public hearings on the Prevention of and Treatment for Substance Abuse Bill [B12-2008] 

The Prevention of and Treatment for Substance Abuse Bill aims, in short, to:

  • Combat substance abuse
  • Establish services and programmes for prevention of substance abuse
  • Provide for early intervention services by various stakeholders
  • Provide for establishment of community –based services
  • Provide for establishment of public halfway houses and registration of private halfway houses
  • Provide for monitoring and assessment of treatment centres and halfway houses
  • Provide for dealing with children addicted to substances
  • Establish programmes for aftercare and reintegration services

Comment: Traditional Courts Bill

The Portfolio Committee on Justice and Constitutional Development will be conducting Public Hearings on the Traditional Courts Bill [B15-2008] which aims:

  • To affirm the recognition of the traditional justice system and its values, based on restorative justice and reconciliation;
  • To provide for the structure and functioning of traditional courts in line with constitutional imperatives and values;
  • To enhance customary law and the customs of communities observing a system of customary law and the customs of communities observing a system of customary law.

 

The hearings will take place on Tuesday, 13 May 2008 from 10:00, in Parliament

Comment: Medicines and Related Substances Amendment Draft Bill

The Department of Health has published the Medicines and Related Substances Amendment Draft Bill for public comment.

The aim of the Medicines and Related Substances Amendment Draft Bill is "To amend the Medicines and Related Substances Amendment Act, 1965, so as to provide for the establishment of the South African Health Products Regulatory Authority; for the certification and registration of products which include medicines and certain foodstuffs and cosmetics, the control of Scheduled substances; for the certification and registration of medical devices; for the abolition of the Medicines Control Council and the Pricing Committee; and matters incidental thereto."

Comment: National Health Amendment Draft Bill

The Department of Health has published the Draft National Health Amendment Bill for public comment.

The aim of the Draft National Health Bill Amendment, 2008, is "To amend the National Health Act, 2003, so as to provide for some definitions; the appointment of the Facilitator; functions of the Facilitator; negotiations on prices; appointment of inspectors; contracts with other persons to assist the Facilitator; the Pricing Tribunal; limitation of liability; the protection of unauthorised access to information; the short title and commencement of the Act; and matters incidental thereto."

Comment: Public Administration Management Bill ( Single Public Service)

The Department of Public Service and Administration is requesting comment on its draft Public Administration Management Bill (also known as draft legislation for a single public service).

The draft Bill proposes to regulate the organisation, management, functioning and staffing matters concerning departments in the national and provincial spheres of government, municipalities, and government components within all three spheres.All interested persons and organisations are invited to submit written comments on the draft Bill not later than 30 April 2008 by emailing the comment to: Rosen@dpsa.gov.za and DanieM@dpsa.gov.za

Comment: Future of Micro-insurance Regulation in South Africa

 National Treasury has released for public comment a discussion paper that proposes a new regulatory environment for entities offering insurance products to low-income earners, entitled: “The Future of Micro-insurance Regulation in South Africa”.
