Report of the Select Committee on
Security and Constitutional Development on the Draft
Regulations made in terms of the
Correctional Services Act, Act No 111 of 1998, amending the Correctional Services
Regulations of 2004, dated 19 October 2011, reports
as follows:
1. Introduction
The amendments were brought about by the Correctional Services Amendment
Act,
Act No 25 of 2008 and the Correctional Matters Amendment Act,
Act No 5 of 2011.
2. Regulations
requiring Parliamentary approval
Regulations 29A and 29B were drafted under
Section 14 of Act No 5 of 2011 amending the principal Act, Section 79 of Act
111 of 1998, in relation to the processes and procedures to follow in the
consideration and administration of medical parole. Regulations 29A and 29B
according to Act No 5 of 2011 must be submitted to Parliament for approval.
2.1 Recommendations
The Committee recommends the approval of
Regulations 29A and 29B.
3. Regulations for consideration
All other proposed Regulations were made in terms
of Section 134 of Act 111 of 1998 and tabled by the Minister of Correctional
Services to the relevant Parliamentary committees.
3.1 Recommendations
The Committee recommends the approval of the
Regulation amendments.
4. Conclusion
The Select Committee on Security and Constitutional
Development, having considered the subject of the Draft Regulations made in
terms of the Correctional Services Act, Act No 111 of 1998, amending the Correctional Services Regulations of
2004, and specifically Regulations 29A and 29B referring to
medical parole, referred to it, recommends the Council approve the Draft
Regulations.
