Committee on Justice and Constitutional Development, dated 27 October 2010
The Portfolio Committee on Justice and
Constitutional Development resolved to initiate a Repeal of the Black Administration Act and Amendment of Certain Laws
Amendment Bill.
The National Assembly noted that the Portfolio Committee on Justice and Constitutional Development was
proposing to introduce a Bill that would extend the date of application of
section 1(3) of the Repeal of the Black Administration Act and Amendment of
Certain Laws Act, No 28 of 2005, to 30 December 2012. The extension was for the purposes of
obtaining greater public input and consensus on contentious issues contained in
the Traditional Courts Bill [B15-2008] and allowing traditional courts to
continue functioning legally.
The National Assembly instructed the Portfolio Committee on Justice and
Constitutional Development to publish the full particulars of its legislative
proposal in the Announcements, Tablings and Committee Reports. The House
furthermore granted the Committee permission to proceed with the proposed
legislation.
Prior notice of introduction of the Bill was given in the Government Gazette, No 33580, dated 23 September 2010, and an
explanatory summary of the draft Bill was published in the same Gazette. The Gazette also contained an invitation to interested persons and
institutions to submit written representations before 26 October 2010. The
Committee received one written submission from the Law, Race and Gender Unit:
The Committee, in accordance with Rule 243, reports that it has introduced the
Repeal of the Black Administration Act and Amendment of Certain Laws Amendment
Bill [B37-2010] (National Assembly- sec 75) by submitting a copy thereof to the
Speaker.
