Report of the Portfolio Committee on Transport on the Civil Aviation Bill [B 73- 2008] (National
Assembly- sec 75), dated 12 November 2008:
The Portfolio Committee on Transport, having
considered the subject of the Civil Aviation Bill [B 73- 2008] (National Assembly-sec 75), referred to
it and classified by the Joint Tagging Mechanism as a section 75 Bill, reports
the Bill with amendments [B 73A - 2008].
The Committee further reports that during the course of the public hearings and
deliberations on the Bill, different views were expressed with regard to the
desirability of different governance arrangements for the Civil Aviation
Authority.
The
Committee decided to accept the governance model proposed in the introduced
Bill. This governance model establishes a Civil Aviation Authority Board which
will be responsible for corporate governance, whilst the core safety and
security regulatory functions of the Agency do not fall under the Board. The
Director of the Agency reports directly to the Minister of Transport on these
matters in order to ensure clear lines of responsibility on matters of critical
national importance. The Committee agreed not to change this proposed model
fundamentally in order to expedite the passing of this legislation.
However,
the Committee recommends that the new Parliament should consider a
comprehensive review of the governance arrangements for regulatory entities of
this kind.
