SUBMISSION BY DAVID DAITZ: NATIONAL ENVIRONMENTAL
MANAGEMENT ACT (NEMA)
Dear Ms. Kakaza,
Please take note of my concern which is directed for the attention of the
parliamentary Portfolio Committee on Environment and Tourism, regarding the
following:
The Government has proposed to amend the National Environmental Management Act
(NEMA) in a way that gives the Minister and MECs power to exempt applicants
from Sections 23 and 24 of the Act. This means that the Minister can decide
whether or not a development goes ahead without any environmental impact
assessment or public consultation. I believe that the adoption of the proposed
amendment puts at risk my constitutional guaranteed right to a safe
environment.
