PROPOSED AMENDMENTS BY THE SELECT COMMITTEE ON
SECURITY AND CONSTITUTIONAL AFFAIRS ON MANDATING PROCEDURES OF PROVINCES BILL
Notes: All the words that are underlined are the proposed amendments to
the Bill
Insert a new sub-clause in clause 5 to read:
2) A Provincial Legislature must facilitate public involvement on
legislation referred to in section 5(1)(a) and (b).
In clause 8 insert a new sub-clause 8(3) to read:
3.If a provincial legislature is not sitting. the
provincial legislature must convene a special sitting to confer authority on
its delegation to cast a vote in an NCOP Plenary.
Please note: Due to these proposed amendments the amendments the
memorandum may need to be slightly changed:
Clause 5 makes provision for legislative mandates requiring both negotiating
and final mandates and also make provision that a provincial legislature
must facilitate public involvement on section 74 and section 76 legislation.
Clause 8 sets out the procedure to be followed for voting mandates and
also prescribe a procedure that must be followed b a provincial legislature
when a provincial legislature is not sitting
