  1. Monitoring of the Equality Courts

 

The following designated Equality Courts were visited during the fiscal year under review i.e. Thohoyandou, Sekhukhuni, Practiseer, Tzaneen, Modimolle and Polokwane. We discovered that the Presiding Officers of the mentioned courts have undergone training on the provisions of the Equality Act. An indication was made that issues of jurisdiction and the tasks of the sheriffs were not adequately dealt with during the training. Also some of the sections of the legislation were not addressed especially the interpretation part and the case law. The Clerks of the Courts reflected their dissatisfaction about the training on the act especially the aspect of discrimination with reference to the listed grounds in the Act and the Constitution were never clearly distinguished from ordinary complaints falling under other pieces of legislation. They further indicated the need for further training specifically on the interpretation of the legislation and case law which was not adequately dealt with.

 

We have noted with grave concern that the Clerks of these courts are overworked. They have overlapping duties which includes:- interpretation, they do cleric duties for the civil and criminal courts, assist in the children’s courts enquiry, maintenance and domestic violence cases respectively. In some instances they act as financial accounts clerks. We have established that since their establishment none of these courts have received a single complaint. This according to the interviewees was ascribed mainly to the fact that members of the public were not familiar with the services of the Equality Courts or its existence. It is therefore difficult to measure performance since there has never been a single complaint recorded since inception. Community outreach programmes did not reflect on their agenda. An exception is made to Modimolle Magistrate Court for attempts made to roll out public education programme. The national launch of these courts did not reach ordinary people on the ground.
