VOTE OF THE KWAZULU-NATAL PROVINCIAL LEGISLATURE:
The
Provincial Standing Committee on National Council of Provinces Matters met on
Friday 18 August 2006 and agreed to mandate the Kwazulu-Natal delegation to the
National council of provinces to support the Second 2010 FIFA World Cup South
Africa Special Measures Bill [B16-2006] as drafted.
This
serves as both the Negotiating and Voting mandate of the Provincial Standing
Committee on national council of Provinces Matters provided that if there are
further amendments to the Bill then the Committee may wish to reconsider its
voting mandate at the relevant stage.
The
delegation is further mandated to consider any additional amendments, providing
that:
1)
the amendment/s does/do not alter the essential elements of the bill and
2)
consensus is reached on the proposed amendment/s by the Kwazulu-Natal
delegation.

NEGOTIATING MANDATE ON SECOND 2010 FIFA WORLD CUP
SOUTH AFRICA SPECIAL MEASURES BILL [B16-2006]
1.INTRODUCTION
The National Council of Provinces referred the Second
2010 FIFA World Cup South Africa Special Measures Bill to the Limpopo
Legislature. The Bill was upon receipt by the Legislature, referred to the
Portfolio Committee on Sport, Arts and Culture.
2. PURPOSE OF THE BILL
The Bill seeks to give effect to the Organising
Association Agreement between FIFA and SAFA and to the guarantees issued by the
government to FIFA for the hosting and staging of the FIFA World Cup South and to
provide for matters connected therewith.
3. BRIEFING BY NCOP DELEGATES
The permanent delegates to the National Council of
Provinces briefed Members of the Portfolio Committee on Sport, Arts and Culture
on the above mentioned Bill on 10 July 2006.
4. PUBLIC HEARINGS
Public hearings were conducted in five districts from
07-11 August 2006 to solicit inputs from various stakeholders.
5. FINACIAL IMPLICATIONS
The Bill will have financial implications to the
province. However, the Committee was assured that moneys would be made
available to ensure that the Province hosts a successful world cup tournament.
6. FINDINGS
The following are the findings of the Portfolio
Committee on Sport, Arts and Culture:

The 2010 FIFA World Cup tournament would be taking
place in provinces; but the Bill entrust powers and outline the role of
National Ministers while excluding the role of the relevant MEC’s in provinces
·
The Bill omitted the clause for those who may violate
the special measures as outlined.
7. NEGOTIATING MANDATE
The Committee having supported the Bill and its
provisions confers a negotiating mandate to the NCOP Delegates to negotiate in
favour of the Bill as introduced in Parliament.

The Portfolio Committee on Education, Culture,
Sports, Recreation, met on the 06 July 2006 for the briefing by the permanent
delegate of the National Council of Provinces on the Second 2010 FIFA World Cup
South Africa Special Measures [B16B-2006]
After consideration of the Bill, the Committee
supports the Bill as it stands.
The permanent delegates representing the Province of
Mpumalanga in the National Council of Provinces are conferred with authority
and mandated to vote in favour of the Bill.

18 August 2006, as follows:
The
Standing Committee on Education, Cultural Affairs and Sport , having considered
the subject of the Second 2010 FIFA World Cup South Africa Special Measures
Bill [B16B-2006] (NCOP), referred to the Provincial Parliament in terms of the
rules of the National Council of Provinces (NCOP), begs to report that it confers
on the Western Cape’s delegation in the NCOP the authority to support the Bill.
