MPUMALANGA PROVINCIAL LEGISLATURE
NEGOTIATING MANDATE
CONSTITUTIONAL TWELFTH AMENDMENT BILL [B23B • 2005]
The Portfolio Committee on Local Government and Housing (the Committee) met on 22 November 2005 for the briefing by Hon. MP, F Nyanda, the Permanent Delegate to the National Council of Provinces (NCOP) on the Constitutional Twelfth Amendment Bill [B23B- 2005] (the Bill). The Department of Local Government and Housing was also attended the briefing.
The Committee conducted hearings to solicit comments from the public on the Bill in the following regions:

COMMENTS/INPUTS
KaBokweni
The members of the public did not have any input contrary to what the Bill proposed.
Thaba Chweu
Members of the public in attendance supported the Bill as was presented.
KwaMhlanga
Members of the public in KwaMhlanga supported the proposals of the Bill as was presented.
Greater Tubatse
A great number of people in attendance held a view that Sekhukhune District and its surroundings should not be split. They support that the District should be incorporated into Limpopo Province.
Greater Marble Hall
Generally members of the public in Greater Groblersdal and Greater Marble Hall are divided on the subject but are certainly in agreement with the spirit of the Bill in so far as it puts to an end the matter of cross-boundary municipality.
Kungwini Municipality
The members of the public opted to discontinue with the public hearing. The public hearing was therefore cancelled on the basis that they indicated their preference that Gauteng Legislature should also form part of the public hearing in order for them to air their views.
FINAL CONSIDERATION OF THE BILL
The Portfolio Committee met again on 29 November 2005 and considered all the inputs and the comments made during the public hearings and made the following findings:
i) Despite unbecoming behaviour, the residents of Kungwini are happy about the proposal to be part of the Metsweding District under Gauteng Province.
ii) Greater Tubatse Municipality, its people and the surrounding areas are in favour of Limpopo Province
iii) Greater Groblersdal and Greater Marble Hall are split in their decision, some favour Mpumalanga while others favour Limpopo Provinces.
RECOMMENDATIONS
The Committee supports the Bill as it stands.
The Permanent Delegates representing the province of Mpumalanga in the National Council of Provinces (NCOP) are conferred with authority and mandated to negotiate in favour of the Bill subject to the above-mentioned proposals.
