Mandate of the Western Cape Provincial Parliament


Report of the Standing Committee on Finance and Economic Development, on the National Credit Bill [B18B -2005] (NCOP), dated 26 October 2005, as follows:


The Standing Committee on Finance and Economic Development, having considered the subject of the National Credit Bill [B18B '2005] (NCOP), referred to the Provincial Parliament in terms of the rules of the National Council of Provinces (NCOP), begs to report that it confers on the Western Cape's delegation in the NCOP the authority to support the Bill with the following amendment and concerns:


Amendment:

On page 71, in line 4, to omit "may" and to substitute "is entitled to".


Concerns:

The committee expresses its concern and requests that the Provincial Minister of Economic Development engage with the national Minister of Trade and Industry to examine those issues raised by the Provincial Department of Economic Development and Tourism with the standing committee, inter alia jurisdiction and the unfounded mandate status of the legislation.


The committee expresses its concern regarding the ambiguity of provincial enabling legislation
