NEGOTIATING MANDATE BILL: EDUCATION LAWS AMENDMENT BILL [B23B-2005]
PROVINCIAL PROCESS:
VOTE OF THE KWAZULU-NATAL PROVINCIAL LEGISLATURE:
The Provincial Standing Committee on National Council of Provinces Matters met today, Tuesday. 25th of October 2005. and agreed to mandate the KwaZulu-Natal delegation to the National Council of Provinces to support the Education Laws Amendment Bill [B23B - 2005] subject to the following questions of clarity:
[A] Clauses
The Committee requires clarity on the practicality of the proposed section 35(2)(b) i.e. categorizing learners into quintiles e.g. what will be process if a learner with wealthy parents is placed into a quintile one school, and vice versa.
[B] Clause 5
The committee requires clarity on the possibility of including an appeal procedure for the action taken by the school in the proposed section 41(1).
The delegation is further mandated to consider any additional amendment providing that-
1 ) the amendments does not alter the essential elements of the Bill; and
2) consensus is reached on the proposed amendment/s by the KwaZulu-Natal delegation.
