Report on negotiating mandate on Education Laws Amendment Bill [B 23B – 2005]

  1. Report on interprovincial negotiation

The Education Laws Amendment Bill has been referred to the Education Sport, Arts, Culture, Science & Technology Committee by the Speaker on 7-October 2005.

2. Briefing

(1) On 13 October 2005, Mr. T. Setona, an NCOP Permanent Delegate briefed the Committee on the content of the bill.

The Committee was informed that the bill aims to amend the following Acts:

a) South African Schools Act, 1996 and

b) The Employment of Educators Act, 1998.

(2) On the 25 October 2005, Adv. J. Machaka, of the Legislature’s Legal Unit briefed the Committee on the technical aspects of the Bill.

2. Consideration

 

The Committee considered the amendments agreed to, and amended the Bill as follows:

Clause 2

Page 3 in line 30 after "suspend" to omit "of" and to substitute "or".

Long title and clause 6

The word "disposal" and "Alienation" have been used interchangeable with regard to both the long title and clause 6.

The long title, which should provide for what the content of the Bill entails, also refer to "movable assets", whilst the content of the Bill in clause 6 refer to "any assets" implying reference to both "movable" and "immovable assets". If the use of the word "movable" in the long title refers to the content of clause 6, then it is proposed that the word "movable assets" instead of "any assets" or "assets" be used in clause 6.

Clause 6

The words "Alienation" and "disposal" are used interchangeably in clause 6 with regard to the heading as well as the content to the clause.

3. Recommendations

 

The Committee recommends that:

  1. Authority be conferred to the Free State delegation to vote for the adoption of the Bill.
