CHAPTER 1


1. Aims and Objectives of the Bill

1.1 Aim

The aim of the Bill is to enhance the socio-economic status and improve the quality of life of older persons, including their well-being, safety and security.


1.2 Objectives

The objectives of the Act are to:

(a) maintain, increase and promote the status, well being, safety and security of older persons;

(b) maintain and protect the rights of older persons as recipients of services;

(c) shift emphasis of care to the community and reduce the need for expensive institutional care in old age homes;

(d) regulate the registration of facilities for older persons;

(e) combat the abuse of older person;

(f) empower caregivers and the community through appropriate targeted education and training;

(g) decide about care in the within own environment; and

(h) reduce pressure on old age homes by making the service accessible in the communities and a their homes.


CHAPTER 2


ENSURING AN ENABLING AND SUPPORTIVE ENVIRONMENT FOR OLDER PERSONS


1. Protection and promotion of rights older persons

2. Facilities and services to comply with national norms and standards

3. Support for services delivery by third parties

4. Key programmes for older persons will be provided in an environment


(a) recognizes the social, cultural, economic and political contribution of older persons;'

(b) promotes participation of older persons Th decision-making processes at all levels;

(c) ensures access to information, education and training of older persons;

(d) promotes development and the basic care of older persons in rural and urban areas,.

(e) promotes the prevention of exploitation of older persons; (D promotes the respect and dignity of older persons

(g) in which older persons receive priority in the provision of basic services;

(h) ensures the optimal level of physical, mental and emotional wellbeing of older persons

CHAPTER 3


COMMUNITY BASED CARE FOR OLDER PERSONS

3.1 Rights of Older Persons in Community Based Services

3.2 Community Based Services

(a) Economic empowerment of older persons

(b) Establishment of recreational opportunities for older persons

(c) Support services, including information, education, counseling services

(d) Facilitate access to spiritual, cultural, medical, civic and social services

(e) Provision of nutritionally balanced meals to needy older persons

(f) Promotion of skills and capacity of older persons to sustain their livelihoods

(g) Access to professional services for the care and rehabilitation to ensure independent living of older persons

(h) The utilization and management of existing facilities for older persons as multipurpose community centres

(i) Development of an integrated community care system

(j) Promotion of intergenerational solidarity


3.2 Home Based Care

This service is directed to frail older persons within the community.

Community based care services are applicable but in addition the following

services are provided:


(a) Services that provide for physical care of older persons;

(b) Provision of professional and lay support for the care of older persons within the home

(c) Provision of respite care for older persons and their carers

(d) Information, education and counseling for family members, care-givers and the community regarding ageing and associated conditions;

(e) Provision of free health care and transport to health facilities and service centres including pay points


3.3 Management of Community Based Services

(a) Registration of service providers and code of conduct

(b) Compliance with norms and standards for community based care

(c) Monitoring of services
