PRESIDENT 'S MINUTE NO 358

In terms of Section 84(2) (1) of the Constitution of the Republic of South Africa 1998 (Act No 108 of 1996). I hereby approve the following periods of special remission to the indicated categories of prisoners, probationers, parolees and day parolees who are or would have been incarcerated or serving sentencing or serving sentencing within the system of community corrections on 30 May 2005.

Six- (6) month's remission of sentence to all prisoners, probationers parolees and day parolees who are or would have been incarcerated or serving sentences within the system of community corrections on 30 May 2005.

Aggressive crimes

Murder

Robbery

Assault with the intent to grievous bodily harm:

Kidnapping/man stealing

Arson

Public violence

Crimes against the safety of the state including sedition, high treason, sabotage and terrorism

Malicious damage to property violations under the Domestic Violence Act

Child Abuse

Any other crime committed while committing any of the above mentioned crimes.

 

Firearm related crimes

All charges related to possession and/or use firearm.

Sexual crimes

Rape Indecent Assault

Intercourse with a child

Child Pornography

Incest

Sodomy

Bestiality

Any other crime committed while committing any of the above mentioned crimes and Any attempt, soliciting or conspiracy to commit any of the above mentioned crimes.

Drug related crimes

Trading, cultivating or manufacturing prohibited drugs or any attempt, soliciting or conspiracy to commit such crime.

Provided that a person, who benefits from this special remission of sentence, will be released within ten weeks ten (10) weeks from 30 May 2005 in order to deal with the necessary administration in a responsible manner.

This special remission of sentence will not been applicable to any prisoner, probationer, day parolees who,

Is certified as mentally ill and is detained in accordance with the Mental Health Act, 1973 (Act No of 1973): Provided that this remission of sentence, will be applicable as soon as such person is decertified and readmitted to prison; escaped / absconded and was still at large on 30 May 2005.

No person may benefit more than once from this special remission of sentence: Provided that where a prisoner is serving a sentence for an offence which is excluded from the awarding of special remission for an additional fourteen (14) months special remission, the prisoner can only qualify for six (6) months special remission. Provided further that the period of community service required of persons serving a sentence of correctional supervision will also be adapted in relation to the special remission received.
