REPORT OF THE PORTFOLIO COMMITTEE ON SOCIAL DEVELOPMENT


Report on the final mandate on the Older Persons Bill {B68-2005]


1. Terms of Reference

The Older Persons Bill herein after referred to as the Bill was referred to the Portfolio Committee on Social Development on the 12 April 2005 by the NCOP Business Committee for consideration.


2. Briefing

The Committee was briefed by the Permanent Delegate Hon A.D,N. Qikani on the content of the Bill.


3. Consultation
The Bill was not taken out for public hearings due to the tight schedule of the Programme of The House.

4. Voting mandate and Conferral of authority
In terms of the Section 65 of the Constitution, the Portfolio committee on Social Development recommends to confer authority of the Eastern Cape Provincial delegate, Hon. AND Qikani, to The National Council of Provinces to vote in favour of the Older Persons Bill.

The Committee resolved that the following final mandate be conferred:

1. To support the amendments proposed- Older Persons Bill in principle with the following concern:-
Emphasis was highlighted with regard to the Definition of "facility", and under Regulations it should be clearly stated that a building or other structure used for accommodations should be inspected by the Provincial Department of Social Development.
