Appointment in terms of section 193(1)(b) of the constitution to assume responsibility for specific obligation at the Thabe chweu Municipality
Please take note that the Provincial Executive resolved at its meeting of 01 December 2004 to invoke section 139(1)(b) of the Constitution at the Thaba Chweu Municipality.
Accordingly and in my capacity as MEC responsible for local Government, I hereby on behalf of the Provincial Executive appoint you to assume responsibility for specific obligation mention herein to extent that the municipality is unable to fulfil them
The specific obligation for which you are to assume responsibility are the following :
1. The appointment of senior managers/heads of departments to fill posts which have been vacant for approximately four years
2. The compilation and submission of annual financial statement which where last submitted in 2002.
3. The institution and finalisation of disciplinary proceedings against officials and/or councillors alleges to have breached the code of conduct for staff members/councillors contained in the Local Government: Municipal Systems Act, 2000
4. He implementation of proper financial management system to ensure compliance with the Municipal Finance Management Act, 2003 in particular compliance with part 1 of chapter 3 which deals with municipality bank accounts, chapter 4 dealing with municipal budget and chapter 6 dealing with assets and liability management as well as revenue and expenditure management;
It will be expected from you, flowing from the list of issues mentioned to within 14 days from date of this letter submit a recovery plan for my approval, Once this recovery plan is approved your terms of reference may be amended in order to enable you to implement the recovery plan. The recovery plan must include firm and unambiguous proposal, including time frames on how each and every issues is to be addressed. You will furthermore be expected to submit bi-monthly reports to myself and/or any person s delegated:
You remuneration and conditions of appointment will be finalised upon approval of the recovery plan
