I am the resident of the above address. The ward is 34 under councillor Mzwandile Matiwane. We never allocated our house in 1999 because they were not in good condition. They are one (1) not plastered. They are leaking, no water meter to other houses .Toilets are not erected. People were not satisfied with the way our councillor handled poor people's subsidies.


In 2002, we formed this (P.H.P.) People's Housing Process. We were 200 beneficiaries we named it "Mbangisi Maki Development Housing Project". It has its own constitution. Our aim is to build houses for the underprivileged. We want to support all those who have no roof over their heads. That is why we decided to use (P.H.P.) People's Houses Process. I therefore submit this project to the portfolio committee. We are also contributing with R 2 479-00. There are those who I know they can not afford this amount. I would like to hear from the portfolio committee what plan can be done for them in order to get their own houses


Lastly, there is a lack of housing delivery to the community. I want this portfolio committee to make it a point that delivery is happening very quick.


The Western Cape is still full of shacks. This project must be recognised as a stepping stone to the really new democracy. People serve government who delivers. The amount of money we have in the bank is R 17 753-32

CONSTITUTION OF THE MBANGISI MAKI DEVELOPMENT HOUSING PROJECT

NAME

A voluntary association is hereby established under the name of Mbangisi Maki Development Housing Project.

  1. Supporting building processes in housing development and the promotion of the quality of life for disadvantaged people.
  2. Involving all the beneficiaries opting for the "People’s Housing Process within the developmental area of Khayetitsha and the surrounding

EXECUTIVE COMMITTEE

The Association shall be governed by an Executive Committee of ten (10) persons, who shall be elected annually at a General Meeting, by the members of the Association.


Any member of the Executive Committee may be removed and replaced by ordinary resolution passed at a special meeting of the Association.


POWER OF THE EXECUTIVE COMMITTEE

  1. The Executive Committee shall consist of a chairperson deputy secretary and a treasurer. The Chairperson (or in his/her absence, the Deputy Chairperson) shall also chair all General Meetings of the Association.
  2. The procedures at meetings of the Executive committee shall be at the discretion of the Chairperson provided that:

a. A Quorum shall exist if there are no less that twelve (12) persons present at a meeting to sit and make decisions.

b. Each member shall have one (1) vote, and the Chairperson shall have no casting vote.

c. Proper minutes shall be kept recording all decisions, proper books of accounts and auditing shall take place in respect of the books of the Association. Auditing shall take place once a year in respect of the books of the Association. A registered auditing company would preferably be used

d. The Committee may resolve to delegate any of its powers to a sub-committee.

e. A "round robin" resolution signed by all committee members shall have the same effect as a resolution duly passed at a meeting


3. The Executive Committee shall have all powers which may be required to effectively administer the affairs of the Association, and in particular have the following special powers:

a. The power to enter into an agreement with the Department of Housing and form partnerships with other role players with a view to assisting the Association in meeting its objectives


b. The power to enter an agreement for the receipt and disposal of grant and other financial assistance which may become available to assist the Association to fulfils its objections.


c. The power to make any decisions which are relevant in order to fulfil its objectives


MEMBERSHIP

The membership of the association shall be open to beneficiaries within the developmental area who qualify for and wish to utilize the Department of Housing’s option of the People’s Housing Project


GENERAL AND ANNUAL GENERAL MEETINGS

  1. General Meetings of members shall be held time to time as the need may require an Annual General Meeting must be held within three (3) months at the end of each financial year. The Annual General Meeting shall appoint the members of the Executive Committee, consider the audited financial statements, effect the appointment of auditors, and generally undertake such other matters as may be appropriate
  2. The Association shall own property and have continued existence apart from its members and it may enter into contracts and sue or be sued in its own name, and shall have legal persona.
  3. This constitution may be amended and the Association may dissolve at any time by resolution passed by not less that two thirds(2/3) of the members present at a duly convened special meeting of the' Association of which at least twenty –eight (28) days prior notice has been given stating the purpose of the meeting
  4. The Association shall comply with the requirements of the Commissioner for inland Revenue and the Director of Fundraising, and the constitutional powers. The Association shall be further qualified in the manner contemplated to add special annexure to this document.
