Report on negotiating mandate on the Dental Technicians Amendment Bill [B63-2003]

1. Terms of reference

The Dental Technicians Amendment Bill [B63-2OO3] has been referred to the Social Services and Health Committee by the Prioritising Committee on 21 October 2003

2. Consultation

The Committee resolved to extend invitations to relevent stakeholders to submit their inputs and invited the MEC for Health and his department to attend the briefing meeting of the Committee.

3. Briefing

(1) On 14 October 2004 Mr T Setona briefed the Committee on the bill.

(2) Advocate J. Machaka, Assistant legal Advisor of the Free State Legislature briefed the Committee on the legal substance and effects of the Bill.

(3) Mr. S Belot, MEG: Health and departmental officials was also present to brief the Committee on the background and contents of the Bill.

4. Consideration

The Committee agreed on the following amendments:

Clause 1

The definition of "informally trained person" states...not less than five years under the supervision a dentist or dental technician and who has been tralned by such dentist or dental technician.. (our emphasis)

The use of the word "such" and not "a" may be misunderstood to mean that the period of five years must have been completed under training by one dentist or dental technician

Clause 6

Page 4 to delete "2003" and to substitute "2004"

 

 

5. Resolutions

The Committee recommends that

Authority be conferred to the Free State Delegation, to vote for the adoption of the Bill with aforementioned amendments
