NEGOTIATING MANDATE: NATIONAL ENVIRONMENT MANAGEMENT: AIR QUALITY BILL [B62D-2003]

The Portfolio Committee Agriculture and Land Administration (the Committee met on 17 September 2004 for a briefing by the permanent delegate of the National Environmental Management: Air Quality Bill [B62D-2003] (the Bill). Present at the meeting was the Mpumalanga Department of Agriculture and Land Administration..

After consideration of he Bill, the Committee raised the following concerns:

(i) That there is no definition of the term controlled fuels under Chapter 1 even though the Bill makes mention of it in Part 4; and

(ii) That clause 34 of the Bill only confers powers to the Minister and is silent about the powers of the MEC.

The permanent delegates representing the provinces of Mpumalanga in the National Council of Provinces are conferred with authority and mandated to vote in favour of the Bill subject to the above-metioned concerns.
