PORTFOLIO COMMITTEE ON FOREIGN AFFAIRS
Report of the Portfolio Committee on Foreign Affairs on the Draft Provisional Rules of the Pan African Parliament, dated 14 September 2004:
The Portfolio Committee on Foreign Affairs, having considered the Draft Provisional Rules of the Pan African Parliament, referred to it recommends that the following amendments be agreed to:
- Rule 2: It was agreed that Rule 2 should read thus: 'The seat of Parliament is South Africa.' Rather than reading: 'The seat of Parliament is South Africa, unless otherwise directed by the Assembly'.
- Rule 3: It was agreed that the word 'pursuant' be replaced with the word 'according', and 'Article' be replaced with 'Articles'.
- Rule 5 (3): It was agreed that the word 'Committee' be replaced with 'Sub Committee'.
- Rule 6: It was agreed that Rule 6 should apply also to Committees.
- Rule 7: It was agreed that, rules 7(1) and (2) be agreed to as amendments; and Rule 7 (3) should be removed, as it was redundant.
- Rules 8(2) and 8(3): It was agreed that they be omitted.
- Rule 8(9): It was agreed that an Acting Vice-President from the same region, to ensure regional representation on the bureau between sittings, should fill a vacant post of Vice President.
It was also agreed that, all the other sub rules be agreed to as amendments.
- Rule 9: It was agreed that the heading of this rule should read thus: 'Code of Conduct for Members' and that the Clerk should be charged with developing a Code of Conduct for visitors, general public and staff.
- Rule 9 (3): It was agreed that this rule should be omitted.
- Rule 11: It was agreed that the last part of Rule 11(1) should read 'third quarter' instead of 'last three months'.
- Rule 11(4): It was agreed that it should reflect a fraction, two thirds, instead of the numbers '50 or 100'.
It was also agreed that the word 'urgent' should be replaced with the word 'special', because it could be confused with the word extraordinary in Rule 11(5).
- Rule 13(3): It was agreed that the word 'sensitization' must be replaced with another word; however, it should not be replaced with the word 'ensure'.
- Rule 17(5): It was decided that this rule should be flagged and that it should be noted that, whoever presides over the election of the PAP President should get the authority from the African Union.
- Rule 17(7): It was decided that a better word should be used instead of the word 'opposite sex'.
- Rule 17(8): It was decided that a better word should be used instead of the word 'opposite sex'. And that a mechanism is devised to ensure the desired results at the stage of nominations.
- Rule 18: It was decided that a better word should be used instead of the word 'opposite sex'.
- Rule 21(1): It was agreed that the delegation representing the South-African Parliament in the Pan African Parliament should mention that the Pan African Parliament could not wait for the four Vice-Presidents to be elected so that it can formulate their duties.
The suggestions of the duties of the Vice Presidents were as follows:
- To manage Committees of the Pan African Parliament
- To monitor and bring on board issues from the Regional Parliaments
- To monitor the organs of the African Union on behalf of the PAP
- To monitor the programmes and the projects of the African Union.
- Rule 23(3): It was agreed that, part of the sentence 'a Vice Chairperson and three (3) rapporteurs' be omitted and the phrase 'and a Vice-Chairperson' be added. And that, the word 'their' be replaced by the word 'its'.
- Rule 23(6): It was agreed that, each Member shall serve on only one Committee
- Rule 23(7): It was agreed that, this rule should be omitted, since it 5 provided for under Rule 26.
- Rules 24 and 25: It was agreed that, the two rules should be put together to make one clean rule. It was also agreed that, the term 'Sub Committees' must be replaced by the term 'Ad hoc-Committees'.
- Rule 25(5): It was agreed that this rule should be omitted.
- Rule 25(6.5) It was agreed that, Members who are Non-Members to a Committee might attend a meeting of that Committee, participate, however may not vote.
- Rule 25(7.6): It was agreed that the South African delegation to the PAP should argue for the opening of Committee meetings to the public, unless in exceptional circumstances.
- Rule 26(6.5): It was agreed that the Chairperson of the Committee would have an original and a casting vote.
- Rule 27: All the suggested technical amendments were agreed to.
- Rule 28(1)(i): It was agreed to replace the word 'deputy' with the word 'Deputy'. This amendment also applies to Rule 28(2).
- Rule 28(3): It was agreed to replace the words 'deputy Clerk' with the words 'Deputy Clerks'. And the word 'partiality' with 'impartiality'
- Rule 28(4): It was agreed that, the word clerk should be replaced by the word 'Clerk'
- Rule 28(5): It was agreed that the word 'deputy' be replaced by the word 'Deputy'.
- Rule 29(u): It was agreed to replace the word 'Dean' with the term 'President of the African Union'.
- Rule 29(iii): It was agreed that the word 'take' be replaced with the words ensure that' and at the end of the sentence to add the words 'are taken'.
