PROPOSED AMENDMENTS TO THE SYSTEMS ACT

 

The proposed amendments to the Local Government: Municipal Systems Act, 2000. is supported. I would however like to provide the following comments:

(a)Ad clause 5

The new clause 21B requires every municipality to establish its own web site and to place such information there as may be prescribed or required by the Systems Act or the Municipal Finance Management Act.

Sub clause two then provides that if a municipality for good reason cannot comply with sub section (1 )(a) it may display the required information on a web site determined or sponsored by DPLG or National Treasury

The current wording of this clause will in my view lead to a number of uncertainties such as

(i)who will a municipality have to approach to determine whether "good reason exist for not complying with subsection (1).

(ii)Who will bear the cost for displaying information on a web site determined by DPLG or National Treasury.

(b) Ad cIause 29

The proposed amendments to Schedule1 is supported. I would like to urge to consider a further amendment to Schedule 1 which will enable an MEC to institute disciplinary steps against a councillor in the event that there is prima facie evidence of a breach of the Code of Conduct and the Speaker and Council refuses to institute disciplinary steps against the Councillor , after having been requested to do so by the MEC.
