After finalising the Immigration Act, the Committee concentrated on performing its oversight function as follows:

13 August 2002

Oversight visit to Film and Publication Board in Pleinpark Building, Cape Town. The Committee was briefed on the workings of the Board and was informed of the need to incorporate effective ways of dealing with Internet child pornography into the Film and Publication Act

20 August 2002

The Committee went on an oversight visit to the Western Cape Regional Home Affairs office in Barrack Street, Cape Town. Most of the Province’s Home Affairs management were in attendance and the Committee was briefed on the registration of children and elderly, the state of the WC Refugee Office, readiness for implementation of the new Immigration Act, the exploitation of the late registration of births, fraudulent marriages, service delivery and problems in the more rural areas. The main problems that were highlighted included the severe understaffing of especially the Refugee Office and the lack of co-operation that was experienced from Head Office especially regarding the granting of permits to refugees that could take up to 12 months and also the delay in receiving a response to queries that was sent to Legal Services at Head Office.

27 August 2002

This oversight meeting was a follow up to information received during the meeting with the Western Cape Home Affairs. The Acting DG, Mr Lambinon briefed the Committee on Restructuring in the Department, Readiness for implementation of the new Immigration Act, Refugee Affairs and more specifically how the Department aimed at correcting the problems experienced by the Western Cape Refugee Office and also on the operation of the Legal Services Directorate.

16 September 2002

Oversight visit to Home Affairs Head Office. After the previous 2 meetings with the Department it became clear that the Committee had to receive an in-depth briefing from the Department on various problematic circumstances that prevailed in the Department. This oversight visit was especially fruitful as it revealed the root causes of problems in the Department rather than just hearing about the fruits of deeper lying causes to specific problems. The most disturbing information that was shared with the Committee is the non-existence and total collapse of electronic systems within the Department. This includes the Movement control System that is totally outdated. The lack of systems is the root cause of inefficiency (paper driven environment) and even creates fertile ground for fraudulent activity.

After the Meeting at Head Office the Committee also went to the Pretoria Regional Office and performed an oversight visit there.

Oversight visit to the Independent Electoral Commission in Pretoria. The Committee was briefed on By-Elections, Registration, Voter Education and the Voters Roll.

15 October 2002

The Committee interacted with the Department to establish how it was faring in its fight against corruption. The Department answered the following questions:

How prevalent is corruption in the Department?

What structures are in place to investigate corruption?

Are adequate resources available to investigate possible cases of corruption?

What is the success rate of the Department in its fight against corruption?

Purpose:

The Chairperson and Ms A van Wyk accompanied the Deputy Minister on a study tour to London to meet with the National High Tech Crime Unit and the Internet Watch Foundation for discussions on how South Africa could improve our capacity for more effective investigation and prosecution of child pornography offenders. What was learnt on the study tour will inform amendments to the Film and Publications Act.
