Purpose of the Presentation
To brief the Portfolio Committee with regard to:
- Legal status of the Secretariat
- Review of the SAPS Act
- Business Plan for the Secretariat for Safety and Security, 2002-2005

Background
- Constitution provides for the establishment of the Secretariat to function under direction of the Minister
- Secretariat is mandated by SAPS Act to provide the Minister with legal, policy, administrative and communication support
- A Business Plan of the Secretariat based on the Secretary's Draft Performance Agreement has been prepared

Legal Status of the Secretariat

The Secretariat currently functions as a Division of the SAPS
- The matter of independence was addressed in the White Paper for Safety and Security
- The matter was also raised with the DPSA which provided a comment
- The matter was sharply raised by the Portfolio Committee
- Minister directed that the matter relating to the legal status be addressed

OPTIONS
-
There are basically three models
= British Model (HIMC)
= South African Defence Secretariat
= Organizational Component model

- Organizational Component Model is the recommended option

Structure of the Secretariat

There are four components
= Office of the Secretary
= Monitoring and Analysis
= Policy Development and Evaluation
= Legal and Corporate Services

- Currently filling in vacant posts
= Chief Director
= Deputy Director Communications
= Deputy Director Liaison

APPROACH TO CIVILIAN OVERSIGHT

Advising the Minister on the functioning of the Service to enable the Minister to direct SAPS
- Monitoring and Evaluation of Functional Activities and Operations of SAPS
- Monitoring and Evaluation of Organizational and Transformation Priorities within SAPS
- Providing Legal and Constitutional advice and Monitoring of Litigations against the SAPS
- Developing Policing Policy and Legislation

Monitoring: Functional Activities and Operations

Effectiveness and efficiency of:
= National Crime Combating Strategy
= SAPS Strategy to Combat Organized Crime
= SAPS Strategy to fight crime against women and children
= Social Crime Prevention Strategy of SAPS

Monitoring: Organizational and Transformation Priorities
- Review of SAPS Training Systems
- Assessment of Recruitment, Deployment, Promotion and Development of Personnel Strategies
- Assessment of application of discipline in SAPS
- Audit of Affirmative Action
- Assessment of Resource Allocation, including the building, upgrading and maintenance of Stations
