National Sport and Recreation Amendment Bill

*Constitutional concerns of Cabinet

*Awaited opinion of SLA in Cape Town who referred us to the SLA in Pretoria.

*SLA in Pretoria submitted a 30 page opinion to us which necessitated redrafting of certain clauses.

Matters at hand are complex and need careful rethinking.

*Aim is to promulgate Bill simultaneously with new South African Boxing Act and new Boxing Regulations

*MEC’s are unhappy

Final redraft of problematic clauses are being finalised whereafter Bill will be resubmitted to the SLA for approval and then to Cabinet.

Provides for better control of sports and recreation bodies and of other matters pertaining to sport and recreation

Boxing and Wrestling Control Amendment Bill

*MEC’s are unhappy with certain provisions of the Bill

*SRSA has encountered great difficulty in its endeavours to try to set up meetings with MEC’s for consultation purposes (since Nov 2001 up to now 3 meetings had to be cancelled due to the MEC’s unavailability)

MEC’s need to be consulted whereafter Bill will be tabled in Parliament

Creates legislation to govern provincial boxing.

South African Sports Commission 4th Amendment Bill.

*Due to the ongoing crystalization of uncertainties with regard to the demarcation of the roles between the SRSA and the SASC the initial draft of the Bill had to be redrafted

*Redrafted version must be submitted to the Minister for his approval in principle after the SRSA has internally approved the Bill.

*Bill will then only be consulted with the SASC whereafter all role players will be approached for their inputs.

Bill has already been redrafted. SASC and role players need to be consulted whereafter Bill will be submitted to Cabinet for approval.

Provides for a clear demarcation of the roles of the Sports Commission and Sport and Recreation South Africa in sport and recreation and also brings the Act in line with the Public Finance Management Act.

REASONS FOR WITHDRAWAL

Code of Conduct Bill

*Australia captures issues pertaining to this in the form a Code only

*The Sports Commission in Australia administers the Code

*The SASC has already been furnished with a copy of the Australian Code of Conduct and requested to draft the said Code draft

*The Code should, therefore, be a policy document and not legislation

Sports Sponsorship Bill

*The findings of the Katz Commission discourage its drafting

*Incentives for development have already been built into the National Sport and Recreation Amendment Bill whereby national federations must ringfence a certain percentage of all income derived from the sale of its television rights in respect of a sports or recreation event for its development.

International Sports Relations Bill

*International protocol is already in place and covers international sports relations adequately

*International and Foreign Affairs are adequately administered by the Department of Foreign Affairs

* Need for legislation is, therefore, superfluous.

Commencement of Act is on hold in order to be promulgated simultaneously with new Boxing Regulations and provincial Boxing Bill

Functions of SRSA’s legal section

To render an efficient legal and advisory service regarding the drafting of legislation, agreements and other legal documents and advising the Department and Minister on all legal related matters thereby enabling them to act in the best interests of sport and recreation in general.

Conclusion

The legal section can, therefore, not be regarded as the core section of the Department in view of its small budget and its service delivery which is rendered on an ad hoc basis most of the time
