DA proposals for certain amendments to the Private Security Industry Regulation Bill (B12-2001)

Infra alternatives for sections 6, 11 and 13 of the Bill as put forward by the Democratic Alliance to the Portfolio Committee of Safety and Security, for consideration:

Establishment and constitution of council and appointment of councillors
6. The Council for the Authority is hereby established and consists of the following councillors:
(a) (i) a chairperson;
(ii) a vice-chairperson; and
(iii) three additional councillors;
appointed by the Minister in consultation with Cabinet, on recommendation of a Selection Committee, consisting of a minimum of three and a maximum of seven persons appointed by the Minister; recommendations made after receiving nominations, compiling a shortlist and interviewing candidates, which nominations and shortlist to be tabled before the Portfolio Committee on Safety and Security before appointments are made; and
(b) (i) the Chairperson of the Standing Committee of Security Service Employers of the Council, as referred to in Section 13(1); and
(ii) the Chairperson of the~ Committee of Security Service
Employees of the Council, as referred to in Section 13
(2).


Ministerial supervision of Authority
11 (i)
If an audit of the financial records of the Authority, or an investigation by an independent assessor, appointed by the Minister, reveals financial or other maladministration of a serious nature at the Authority or the serious undermining of the effective functioning of the Authority, the Minister may, after consultation with the Council and the Portfolio Committee on Safety and Security, if practicable, dissolve the Council and appo~nt a new Council in terms of Section 6 (a).

(ii) In the event of the Minister exercising his authority in terms of Section 11 (i), he may, in consultation with Cabinet, appoint an interim Council for a period not exceeding six months.
