Ad Section 4
Ad 4 (3):

Insert (h):

Ad Chapter 3
[ Chapter 3 of the Draft - Dealing with 'Governance of Public Centres]

Note . Section 7 of the Draft explicitly excludes AGET institutions created ito Section 21(1) (dA ) of SASA.
· The Section in SASA is located in the part of the SASA Act dealing with additional competencies that schools may obtain from the HOD; thus creating the impression that the existing school governing body will exercise control over the AGET 'institution '
[Same being the informed position of the Department]
· Chapter 2 of the Draft is not subject to this exclusion and in turn implies the opposite namely that a separate entity
["... Every Public Centre is a juristic person ..." with a distinct control structure will be created.
· clearly this ambiguity must be dealt with.

Amending:
(a) Every public centre must establish a9overnin9 body, except a public centre contemplated in section 21(1) (d) of the South African Schools Act, 1996 (Act No 84 of 1996), or section 9 of the further Education and Training Act, 1998 (Act No 98 of 1998),
(b) The existing governing body will exercise the control required,
