Judicial Matters Second Amendment Act, 1998 (Act 122 of 1998): Amends a number of provisions of the Insolvency Act, 1936, and provides for technical amendments to various other Acts.

* Sections 6, 9 and 11 to 15 commenced on 1/4/99.
* Sections 1 to 5 and 10 commenced on 1/9/00.

* Sections 7 and 8 (Sec 49): It was intended to put these sections into operation with effect from 1 August 2000. On request, the sections were not put into operation. Consultation between the two Ministers involved is being arranged.
* The Minister decided unilaterally that sections 7 and 8 should be implemented with effect from 1 December 2000. The necessary documentation in this regard was drafted and submitted to the Minister by HMS. The President’s Office decided against the implementation of the sections at the aforementioned date. It is up to the Minister to deliberate with the Minister of Safety and Security to come to an agreement regarding the implementation of these sections.

A recommendation regarding the implementation of the Act, with the exception of sections 10, 14, 16 and 51, was submitted to the Minister on 23 February 2001.

* Draft regulations for the purposes of sections 18(1), 22, 53(1), 54 and 75 were sent to interested parties for comment. The closing date for comment was 31/7/00.
The draft regulations were finalized and scrutinised by the State Law Advisers.
* Draft regulations were submitted to the Minister and to the Department of State Expenditure for approval.
*Draft regulations were approved by the Minister on 23 October 2000. The approval of State Expenditure has been obtained. A memo to the Minister to promulgate the regulations and advise the President on a date of commencement is submitted to the Minister on 23 February 2001.
* Remaining sections: Draft regulations must be formulated. Role players were approached for comment.

The Act, with the exclusion of sections 4 and 10, came into operation on 30/11/2000. The commencement of the remainder of the Act is dependent on the finalisation of regulations.

Draft regulations have been formulated and discussed at a workshop. The draft regulations have been finalised and distributed to role players for comment. These comments have been considered. Amendments to the draft regulations to accommodate the comment received is being effected. A date for the implementation of the remainder of the Act will soon be determined.

Promotion of Equality and Prevention of Unfair Discrimination Act, 2000 (Act 4 of 2000)

* Draft regulations were formulated and sent out to interested parties for comment. After the evaluation process it was decided to discuss it on a workshop to be arranged by HDW, which took place and the regulations are in the process of being amended. The regulations was submitted to the State Law Advisers and their input in currently awaited where after the draft regulations must be submitted to the State Language Services and the Department of State Expenditure
* In terms of section 30 the Regulations must be tabled in Parliament before publication.
